O texto pretende demonstrar as bases do movimento de direito alternativo desenvolvido no Brasil durante e após o período de redemocratização do
país. Para tanto, examinam-se a produção bibliográfica e jurisprudencial do magistrado, considerado um dos mais importantes expoentes do MDA,
Amilton Bueno de Carvalho, originada (no que aqui se define como sendo) sua primeira fase. Assim, fazendo um recorte temporal entre o final dos
anos oitenta do século XX até a primeira década do século XXI, o estudo aponta o Humanismo e a Sociologia Jurídica como os marcos fundamentais
do pensamento alternativo. As fontes consultadas nesta pesquisa constituem acervo bibliográfico e jornalístico atinentes ao movimento de direito
alternativo, assim como manuscritos e rascunhos pessoais do próprio Amilton Bueno de Carvalho.

The paper intends to show the foundation of the movement of the alternative law developed in Brazil during and after the country’s democratization period. To do this, the intelectual production (literature and law decisions) of the judge Amilton Bueno de Carvalho is analyzed. Thus making a time frame between the end of the eighties of the twentieth century to the first decade of this century, the study points humanism and the sociology of law as the basis of alternative thinking. The sources consulted in this research are bibliographic and journalistic relating to the movement of alternative rights, as well as manuscripts and personal sketches of Amilton Bueno de Carvalho.
