O presente artigo discute a história das relações políticas, ideológicas e jurídicas desenvolvidas entre a Ação Integralista Brasileira (AIB) e o Governo Vargas, buscando determinar o papel ideológico-jurídico que os integralistas tiveram na consolidação do Estado Novo. Para tanto, a primeira seção deste trabalho traz a perspectiva da história hermenêutica do direito de Pietro Costa, adotada neste trabalho. Após, apresenta-se na segunda seção o desenrolar histórico entre o integralismo e o governo federal, iniciando em 1934 nos momentos anteriores à Intentona Comunista; passando pelo Golpe de 1937, que culmina na manobra elaborada por Getúlio Vargas que redireciona os camisas-verdes como inimigos do Estado; até o exílio de Plínio Salgado em Portugal após o putsch integralista fracassado em 1938. A terceira seção, por sua vez, busca apresentar concretamente as proximidades ideológicas entre os atores políticos aqui discutidos, partindo da inserção de ambos na crise liberal, que constrói a cultura política antiliberal do período entreguerras. Por fim, discutem-se as perspectivas jurídicas da AIB e do Governo Vargas a partir do ferramental do juridicamente relevante, trazido pela perspectiva da história hermenêutica do direito, utilizando-se das obras de Miguel Reale — jurista integralista — e Francisco Campos — jurista estadonovista.
This article discusses the history of the political, ideological and legal relations developed between the Brazilian Integralist Action (AIB) and the Vargas Government, seeking to determine the ideological and legal role that the integralists played in the consolidation of the Estado Novo. In order to do that, the first section of this work brings the perspective of the hermeneutic legal history of Pietro Costa, adopted in this work. Then, in the second section, the historical development between integralism and the federal government is presented, starting in 1934 in the moments prior to the Intentona Comunista; passing through the Coup of 1937, which culminates in the maneuver elaborated by Getúlio Vargas that redirects the green-shirts as enemies of the State; until Plínio Salgado's exile in Portugal after the failed integralist putsch in 1938. The third section, in turn, seeks to concretely present the ideological closeness between the political actors discussed here, starting from the insertion of both in the liberal crisis, which builds the anti-liberal culture in the interwar period. Finally, the legal perspectives of the AIB and the Vargas Government are discussed based on the tooling of the legally relevant, brought by the hermeneutic legal history perspective, using the works of Mi-guel Reale – integralist jurist - and Francisco Campos — Estado Novo jurist.
