Kafka é amiúde considerado um escritor modernista que desafiaria o pressuposto hermenêutico segundo o qual o mundo é passível de compreensão. Este ensaio, inscrito na intersecção interdisciplinar do Direito & Literatura, desafia essa leitura do universo ficcional kafkiano, argumentando, a partir dos aportes da hermenêutica filosófica e do romance O Processo, que existe uma hermenêutica kafkiana e que ela é uma hermenêutica da intransigência, cujo potencial para os estudos jurídicos ainda não foi completamente explorado, a despeito de seu imensurável valor na luta pelos direitos humanos. A conclusão do texto apresenta a questão da possibilidade de execução da pena antes do trânsito em julgado à luz das lições que a obra de Kafka nos transmite a cada leitura.

Kafka is often considered a modernist writer who challenges the hermeneutical assumption that the world is understandable. Inscribed at the intersection between Law and Literature, this essay challenges this reading of the fictional Kafkaesque universe, claiming, based on the contributions of philosophical hermeneutics and the novel The Process, the existence of a Kafkaesque hermeneutics: a hermeneutics of intransigence. Despite its immeasurable value in the fight for human rights, the potential of such hermeneutics for legal studies has not yet been fully exploited. The conclusion of the text raises the question of the possibility of executing the sentence before the final judgment, in light of the lessons conveyed by Kafka’s work at each reading.
