FERDINAND LASSALLE X KONRAD HESSE: AFINAL, QUAL É A ESSÊNCIA DE UMA CONSTITUIÇÃO?

A constituição é uma norma supra-legal, que constitui a base de todo o ordenamento jurídico
de uma nação, sendo assim, sua aplicação e eficácia constituem em fator determinante na ordem e
pleno funcionamento de um Estado. Entretanto, no decorrer dos séculos, tanto no âmbito jurídico,
político e na sociedade em geral surgiram alguns questionamentos sobre qual seria realmente os
fatores que condicionavam a vigência e força de uma constituição. No entanto no século XVIII surgiu
um autor, Ferdinand Lassalle, que definiu a constituição como sendo a soma dos fatores reais de poder
que regem uma nação, em sua obra ele ressaltou esses fatores e afirmou que sem a presença deles uma
constituição não teria força e simplesmente não passaria de uma folha de papel escrita. Além disso,
posteriormente, no século XIX, outro autor, Konrad Hesse, abordou o assunto, ele diferentemente de
Lassalle, afirmou que a essência de uma constituição encontra-se em sua força normativa, ou seja, em
seus aspectos jurídicos relacionados com a realidade sócio-política de um Estado. Demonstra-se neste
artigo este debate vultuoso, sobre qual seria a essência de uma constituição.

The Constitution is a high legal norm that constitutes the basis of all the legal planning of a
nation, therefore its application and effectiveness are an important factor in the order and full
operation of a State. Meanwhile, during the centuries, in the legal, political and social scopes there has
been some questioning about which would really be the factors that conditioned the validity and
strength of a constitution. However, on the 18
th
century an author came, Ferdinand Lassalle, and
defined constitution as being the sum of real power factors that govern a nation, on his work he
highlighted these factors and said that without their presence a constitution wouldn’t have strength and
would simply be no more than a sheet of written paper. Besides, after that, on the 19
th
century, another
author, Konrad Hesse, approached the subject, different from Lassalle, he said that the essence of a
constitution is found in its normative force, meaning, in its legal aspects related with the socialpolitical reality of a State. It is shown on this article this sterling debate, about which would be the
essence of a constitution.
