O presente texto apresenta as dimensões fundamentais do Estado de Direito em seu sentido jurÃdico-institucional e verifica se essas dimensões foram acolhidas pela ordem jurÃdica brasileira. Além disso, analisa o principal desafio desta estrutura especÃfica na atualidade no paÃs: a permanência da cultura patrimonialista e, em consequência, o déficit de república que os valores desta tradição produzem.
This paper presents the fundamental dimensions of the state of law in its juridical and institutional sense and studies if these dimensions have been adopted by the Brazilian legal order. Furthermore, it analyses the prime challenge to this special structure in today’s Brazil, the persistence of the patrimonial culture and therefore the lack of republic which the values of this tradition use to bear.
