A proliferação de conflitos envolvendo os interesses de ordens jurídicas diversas no contexto da sociedade globalizada requer uma abertura do constitucionalismo estatal para outras ordens jurídicas, a fim de que haja um intercâmbio e aprendizado entre os envolvidos a fim de solucionar conflitos de interesses comuns. Esse entrelaçamento entre as ordens jurídicas de níveis múltiplos, chamado por Marcelo Neves de “transconstitucionalismo”, seria uma nova fase do constitucionalismo moderno, uma etapa necessária, diante da ineficácia das ordens constitucionais internas de lidar com problemas envolvendo direitos humanos e fundamentais que ultrapassem a zona de interesse de suas fronteiras territoriais. Em uma sociedade complexa e heterogênea da atualidade, principalmente em um Pais de formação cultural e étnica bastante diversificada como o Brasil, conflitos sócio-culturais entre as diversas pretensões normativas dos distintos grupos que aqui convivem é algo inegável que precisa ser harmonizado, de modo a permitir o convívio das diferentes pretensões de inclusão jurídica desses grupos, sem que haja uma sobreposição de interesses politicamente dominantes. Dessa forma, o presente artigo propõe a prática do transconstitucionalismo tanto internamente (diálogo de aprendizado entre a ordem jurídica local e as ordens nativas) como externamente (diálogo de aprendizado entre as Cortes e experiências dos diversos países latinos que abrigam em seu território populações indígenas), como um mecanismo capaz de assegurar à Constituição brasileira a obtenção da legitimidade democrática necessária à realização de sua força normativa, cumprindo seu papel de norma suprema da sociedade civil e política.

The  proliferation  of  conflicts  involving  the  interests  of diverse legal orders in the context of globalized society requires an openness of state constitutionalism to other legal orders in order to exchange and learn among those involved in order to solve common conflicts of interest. This interlocking of multiple-level legal orders, called by Marcelo  Neves  of  "transconstitutionalism",  would  be  a new  phase  of  modern  constitutionalism,  a  necessary step,  given  the  inefficiency  of  internal  constitutional orders  to  deal  with  problems  involving  human  and fundamental rights that go beyond Area of interest of its territorial  borders.  In  a complex  and  heterogeneous society  today,  especially  in  a  country  of  cultural  and ethnic  formation  quite  diverse  as  Brazil,  socio-cultural conflicts between the various normative pretensions of the   different   groups   that   live   here   is   something undeniable that needs to be harmonized, in order to To permit  the  coexistence  of  the  different  claims  of  legal inclusion   of   these   groups,   without   there   being   an overlapping of politically dominant interests. In this way, the     present     article     proposes     the     practice     of transconstitutionalism    both    internally    (dialogue    of learning between the local legal order and native orders) and externally (dialogue of learning between the Cortes and  experiences  of  the  various  Latin  countries  that shelter  in  their  territory  native  populations)  ,  As  a mechanism  able  to  assure  to  the  Brazilian  Constitution the obtaining of the democratic legitimacy necessary to the  accomplishment  of  its  normative  force,  fulfilling  its role of supreme norm of the civil and political society.
