This essay proposes to study and analyze the dialectical relationship between the human being as an entity –essence- and the world of crime –circumstance-, based on a history and a casuistry, for which the study is deployed, in a double perspective; the first, that of the crime committed by citizens and, the second, that of the crime committed by public authorities, but not only from a legal point of view, but also as a multi-faceted vision -of several faces-, taking into account that man - person - and the Law is not only a “being” but also a “must be”, analyzing not only philosophically, but also in it, the due ontological, axiological and epistemological approaches for the better understanding of man and Law in its becoming.

Resumo Espanhol:

El presente ensayo propone estudiar y analizar la relación dialéctica entre el ser humano como ente –esencia- y el mundo del delito–circunstancia-, a partir de una historia y una casuística, para lo cual se despliega el estudio, en una doble perspectiva; la primera, la del delito cometido por los ciudadanos y, la segunda, la del delito cometido por las autoridades públicas, pero no solo desde una visión jurídica, sino, como una visión poliédrica –de varias caras-, tomando en cuenta que el hombre – persona - y el Derecho no solo son un “ser” sino también, son un “deber ser”, analizando no solo filosóficamente, sino en ello, los debidos enfoques ontológicos, axiológicos y epistemológicos para la mejor comprensión del hombre y el Derecho en su devenir.
