EL HABITUS POSITIVISTA EN EL CAMPUS JURÍDICO LATINOAMERICANO

This text analyzes the symbolic elements of language and reproduction in the formation and exercise of legal culture and takes Ecuador as a concrete case. The theoretical framework is based on Bourdieu‘s studies on the campus, the habitus and the symbolic elements of law; however, it does not neglect other relevant authors on the subject. The article is divided into three parts. The first part analyzes the construction of homo juridicus, not as the individual transformed into a subject of rights but as one who is subjected to the law through the pedagogical action assimilated in the training of the lawyer. The second part describes the professional practice of jurists and judges, who have been pedagogically structured under a positivist current, and additionally shows some distortions in the practice of law, produced by certain local judicial customs. The third part shows the difficulties in the change of legal culture in the country, taking as a starting point the 2008 Constitution and the new State model. Finally, some reflections are made on what a change of legal culture means in the framework of Latin American constitutionalism and legal pluralism.

El presente texto analiza los elementos simbólicos, de lenguaje y de reproducción, en la formación y el ejercicio de la cultura jurídica y toma como caso concreto el Ecuador. El marco teórico se basa en los estudios de Bourdieu sobre el campus, el habitus y los elementos simbólicos del derecho; sin embargo, no deja de lado otros autores relevantes en la temática. El artículo se divide en tres partes. La primera parte analiza la construcción del homo juridicus, no como el individuo transformado en sujeto de derechos sino como aquel que es sujetado por el derecho a través de la acción pedagógica asimilada en la formación del abogado. La segunda parte describe el ejercicio profesional de juristas y jueces, que han sido estructurados pedagógicamente bajo una corriente positivista, y adicionalmente muestra algunas distorsiones en el ejercicio del derecho, producidas por ciertas costumbres judiciales locales. La tercera parte muestra las dificultades en el cambio de cultura jurídica en el país, tomando como punto de partida la Constitución de 2008 y el nuevo modelo de Estado. Finalmente, se hacen ciertas reflexiones sobre lo que significa un cambio de cultura jurídica en el marco del constitucionalismo latinoamericano y el pluralismo jurídico.
