Discute-se se a efetividade dos direitos fundamentais está atrelada à necessidade de aquilatar a
densidade normativa dos enunciados prescritivos veiculadores de direitos fundamentais, pois, a partir
desta constatação, define-se em que grau deve interferir o legislador ordinário com vistas à concretização
jusfundamental. Esta aferição de densidade normativa passa pela distinção entre regras e princípios.
Robert Alexy é o mais árduo defensor desta necessidade. Demonstra-se neste artigo que o deslocamento
do problema da efetividade dos direitos fundamentais para o campo da distinção acima apontada traduz
um falso problema.

It is discussed if the effectiveness of the human rights is harnessed to the need of valuing the
normative density of the human rights prescriptive backer´s statements, because, starting from this
verification, it is defined in what degree the ordinary legislator should interfere with views to the
materialization of this rights. This gauging of normative density goes by the distinction between rules and
rules. Robert Alexy is more arduous defender of this need. It is demonstrated in this article that the
displacement of the human rights effectiveness problem, for the field of the distinction above pointed,
translates a false problem.
