O trabalho aborda a especificidade das práticas biomédicas de reprodução humana assistida face à sistemática
constitucional. Há um estudo da doutrina do consentimento informado em função da existência e supremacia do
princÃpio da dignidade da pessoa humana como proteção maior dos desdobramentos do direito à vida, à saúde, Ã
integridade fÃsica e à informação. Interessa aos estudiosos da Bioética, do Direito Civil e do Direito
Constitucional, analisando a integral tutela à vida, prevista na Constituição Federal de 1988, particularmente
quanto à obrigatoriedade de consentimento livre e esclarecido nas investigações em seres humanos e no uso das
técnicas de reprodução assistida.
This essay addresses the specific practices of biomedical assisted human reproduction under the constitutional
system. A study of the doctrine of informed consent is made, according to the existence and supremacy of the
principle of human dignity and protection of the largest developments of the right to life, health, physical
integrity and information. This subject interests experts of Bioethics, of Civil Law and Constitutional Law,
examining the full protection of life, under the Federal Constitution of 1988, particularly as the
requirement of free and informed consent in investigations into human beings and the use of techniques of
assisted reproduction.
