A crise do Estado Social afetou a efetivação dos direitos sociais e os governos alegam que os serviços públicos devem se limitar à teoria da reserva do possÃvel, pois esta teoria se funda na supremacia do interesse público. Porém, as Constituições contemplam princÃpios e direitos que se posicionam acima das decisões polÃticas. Este artigo produz uma leitura crÃtica da referida teoria.

The crisis of the Social State affected the effect of the social rights and the governments allege what the public utilities has to limit by the reserve of a possible one, since this theory is based on the supremacy of the public interest. However, the Constitutions contemplate beginnings and rights that are positioned above the political decisions.
