Na quadra histórica em que vive o Brasil, onde quase 25% da população é detentora de alguma deficiência, chegando em alguns Estados da federação a ultrapassar a marca dos 27% de pessoas com deficiência, segundo o senso de 2010, vem-se por questionar que tutelas jurídicas o direito vem proporcionando a essa parcela tão significativa da população brasileira. Nesse estudo será trazido à baila a recentíssima Lei nº 13.146/15 que lavra o Estatuto da pessoa com deficiência, a qual oferta uma nova modelagem jurídica ao tratamento destinado à inclusão de pessoa com deficiência, inovando em certos momentos e consolidando outras matérias, tudo em favor da promoção da dignidade da pessoa humana. A pesquisa em tela, fazendo uso de uma metodologia de análise qualitativa, usando-se os métodos de abordagem hipotético-dedutivos de caráter descritivo e analítico, tem por linha de fundo estudar o plexo de direitos e garantias relacionado com as pessoas com deficiência, desenhando o microssistema jurídico especial galgado pela normatividade extraída da Constituição e dos diversos ramos do direito.

In the historical period in which he lives Brazil, where nearly 25% of the population owns a disability, coming in some states of the federation to surpass the mark of 27% of people with disabilities, according to the judgment of 2010, comes up for questioning that legal guardianship the right has been providing this as a significant portion of the population. In this study will be brought to the fore the very recent Law nº 13.146/15 tilling the person’s status with disabilities, which offer a new legal modeling treatment for the inclusion of people with disabilities, innovating at certain times and consolidating other materials, all in the promotion of human dignity. The research in question, making use of a methodology of qualitative analysis, using the methods of hypothetical-deductive approach of descriptive and analytical character, is the bottom line study plexus rights and guarantees related to persons with disabilities, drawing the special legal microsystem climbed extracted by the normativity of the constitution and the various branches of law.
