O presente artigo tem por objetivo apresentar uma nova teoria sobre os direitos humanos fundamentais que pretende contribuir para o processo de avaliação e resolução de casos concretos, conciliando as teses relativistas que se opõem ao respeito universal destes direitos, com as posições universalistas, as quais
defendem a sua observância incondicional em todas as culturas. O estudo começa com a análise epistemológica dos direitos humanos fundamentais e as suas dimensões de atuação, para então apresentar-se um conceito ético destes direitos, associado a uma ferramenta hermenêutica, que, juntos, são capazes
de auxiliarem a compreender e resolver situações complexas envolvendo a violação de direitos humanos.
The objective of this paper is to present a new theory of the fundamental human rights that seeks to contribute to the process of evaluation and resolution of concrete cases, by reconciling the relativism theses who were opposed to the universal respect for these rights, with universalism theses which defend its unconditional respect for all cultures. The study starts with the epistemological analysis of fundamental human rights, and its dimensions, to then submit an ethical concept of these rights, associated with a tool hermeneutics, which, together, are able to assist in understanding and resolving complex situations involving the violation of human rights
