DIREITOS HUMANOS E TRABALHO INFORMAL: O CASO DO MOTO-TÁXI

Resumo Português:

Apesar de ser uma declaração sem obrigatoriedade legal
e não um tratado, a Declaração Universal dos Direitos Humanos
influenciou diversos documentos no sentido de garantir direitos
básicos e liberdades fundamentais a todos os seres humanos, sem
qualquer distinção. No entanto, quando se analisa o trabalho
cotidiano dos moto-taxistas, uma nova classe de trabalhadores
urbanos que realizam o transporte de passageiros e pequenas
cargas, verificamos a ausência de alguns direitos básicos, já
previstos na Declaração de 1948. Neste sentido, este artigo busca
debater se os direitos básicos e liberdades fundamentais, expressos
na Declaração Universal dos Direitos Humanos, garantam um
exercício mais humano da profissão de moto-taxista.

Although a declaration without legal obligation and not a
treaty, the Universal Declaration of Human Rights has influenced
several documents to ensure basic rights and fundamental freedoms
for all human beings without any distinction. However, when
analyzing the daily work of motorcycle taxi driver, a new class of
urban workers who perform the transport of passengers and small
loads, verify the absence of some basic rights already provided in
the Declaration of 1948. Therefore, this article seeks to discuss
whether the basic rights and fundamental freedoms, expressed in
the Universal Declaration of Human Rights, ensuring a more humane
exercise of the profession of motorcycle taxi driver.
