O presente trabalho visa investigar a pertinência leitura da biopolítica para a compreensão do fenômeno jurídico contemporâneo. A pesquisa teve como objetivo específico analisar as principais contribuições de Michel Foucault, Giorgio Agamben e Roberto Esposito para o tema. Para tanto tomou-se como metodologia a análise conceitual para a leitura das categorias que abarcam a relação entre direito e vida nas principais obras dos autores, levantando as especificidades das construções teóricas e dos resultados em cada abordagem. Em Michel Foucault é visível uma dimensão das relações de poder que possui pontos de intersecção com o direito: a biopolítica. A análise desta categoria revela o direito em relação indireta com a vida, mediada pelo biopoder. Já em Agamben percebe-se uma relação direta entre direito e vida a partir de conceitos limiares que evidenciam as formas de constituição da dimensão jurídica por elementos extrajurídicos. Por outro lado, Esposito demonstra a imbricação da semântica da autoconservação da vida em algumas das principais categorias jurídico-politicas da modernidade. Finalmente, foram exemplificados sumariamente fenômenos contemporâneos que podem ser cotejados com as categorias analisadas.

The present work aims to investigate the relevance of the biopolitical reading to the understanding of the contemporary legal phenomenon. The research had the specific objective of analyzing the main contributions of Michel Foucault, Giorgio Agamben and Roberto Esposito to the theme. In order to do so, the conceptual analysis was selected as a methodology for the reading of the categories covering the relationship between law and life in the authors’ main works about the theme, highlighting the specificities of the theoretical constructs and the results in each approach. In Michel Foucault is visible a dimension of the relations of power that has points of intersection with the law: the biopolitics. The analysis of this category reveals the law in indirect relation with life, mediated by biopower. In Agamben, a direct relation between law and life is perceived from threshold concepts that evidence the forms of constitution of the juridical dimension by extralegal elements. On the other hand, Esposito demonstrates the imbrication of the semantics of self-preservation of life in some of the main legal-political categories of modernity. Finally, contemporary phenomena that can be faced with the analyzed categories were summarized.
