O presente artigo pretende examinar a relação conflituosa que se estabelece entre lei e justiça, para desvelar a necessidade de, no âmbito doméstico e internacional, haver uma busca constante por um direito que se afaste do mero tecnicismo concernente à aplicação fria de textos legislativos e promova a primazia moral da ideia de justiça, critério básico de legitimação do direito. Para atingir tal objetivo, inicialmente será feita uma explanação crítica a respeito da técnica, com vistas a demonstrar suas repercussões no e sobre o direito.

This paper intends to examine the conflicting relationship established between law and justice, to reveal the need for, domestically or internationally, a constant search for a law thatmoves away from mere technicality concerning the cold application of legislation and promotes the primacy of the moral idea of justice, the basic criterion for the legitimation of law. To achieve this, initially there will be a critical explanation about the technique, in order to demonstrate their impact in and over the law.
