O presente artigo tem por objetivo analisar as inter-relações existentes entre o desenvolvimento sustentável, o direito e a concepção social de raça, a partir da proposição de reflexões jurídicas e de boas práticas voltadas à negritude. Assim, partindo da contextualização da Década Internacional de Afrodescendentes, estabelecida pela Organização das Nações Unidas, divide-se o estudo em três partes. Na primeira, expõe-se a perspectiva dúplice do direito como mecanismo de exclusão e instrumento de inclusão. Na segunda, reflete-se sobre as conceituações da discriminação e de seu impacto negativo sobre a negritude. E, na terceira, centra-se na concepção de sustentabilidade social e em estratégias de equidade racial como meios de fomento ao desenvolvimento sustentável. Por conseguinte, assevera-se a importância do combate às discriminações como fator de desenvolvimento e garantia fundamental das pessoas negras.

This article aims to analyze the interrelationships between sustainable development, law and the social conception of race, from the proposition of legal reflections and good practices focused on blackness. Thus, starting from the contextualization of the International Decade of Afro Descendants, established by the United Nations, the study is divided into three parts. In the first one, the double perspective of the right as a mechanism of exclusion and instrument of inclusion is exposed. In the second, it is reflected on the conceptualizations of discrimination and its negative impact on blackness. And, in the third, it focuses on the concept of social sustainability and on racial equity strategies as a means of promoting sustainable development. Therefore, the importance of combating discrimination as a factor of development and fundamental guarantee of black people is stressed.
