O presente trabalho tem por objetivo discutir o fenôme-no global da involução democrática no século XXI em sua relação com a apropriação de discursos de crise e a instituição de uma nova interpretação acerca dos limites constitucionais para o exercício au-toritário do poder, a partir das recentes experiências húngara e bra-sileira. Partindo-se de uma abordagem histórica da construção do constitucionalismo de transição democrática do fi nal do século XX, o estudo se propõe a verifi car as proximidades existentes quanto a forma com que as elites políticas eleitas de ambos países, articu-lando legitimidade popular e cenários de crise, acumulam poderes e preservam, ao mesmo tempo, a aparência democrática de suas instituições. Assim, a análise se volta à identifi cação dos padrões de avanço e de legitimação do autoritarismo constitucional na Hun-gria e no Brasil, revelando a possível e necessária dissociação entre os conceitos de Constituição e Democracia.
The current academic work aims at addressing the XXI cen-tury global phenomenon of democracies` decline with regards to the appropriation of crisis speeches and the institution of a new interpreta-tion on the constitutional limits for the authoritarian use of power, con-cerning notably the Hungarian and Brazilian recent experiences. From a historical approach of the democratic transition constitutionalism of the late XX century, the research pursued to attest the existent simi-larities on how the elected political elite of both countries seizes power and simultaneously preserves the democratic facade of their institutions, by articulating popular legitimacy and crises scenarios. Therefore, the analysis focused on the identification of common patterns of rise and legitimacy of constitutional authoritarianism in Hungary and Brazil, un-veiling the possible and necessary dissociation between the concepts of Constitution and Democracy.
