The main premise of this paper is that an economic theory underlies every theory of justice, and therefore, the judicial decision must respond to the articulation of both in order to avoid inefficient rulings (since the assignment) and inequitable rulings (since the distributive sphere).
La premisa principal del presente trabajo, es que a toda teoría de la justicia le subyace una teoría económica, y, por lo tanto, la decisión judicial debe responder a la articulación de ambas para evitar fallos ineficientes (desde la asignación) e inequitativos (desde la esfera distributiva).
