O presente artigo tenta aproximar as impressões distópicas de George Orwell em seu livro “1984”, principalmente a criação do controle linguístico estatal através da Novafala, e a análise crítica da linguagem jurídica como aparato técnico de exclusão e domínio. Para tanto, foram utilizadas fundamentalmente as análises de autores como Luis Alberto Warat e Michel Foucault como base crítica ao uso de tecnicismos e interpretações arbitrárias pelo judiciário e burocracia estatal. Deste modo, o trabalho tenta desconstruir o argumento filosófico-técnico do modelo de linguagem abordado, questionando sua função semântica e pragmática em um mundo onde abismos educacionais são comumente presentes nas relações sociais.
The present article attempts to approximate the dystopic impressions of George Orwell in his book "1984", mainly the creation of state linguistic control through Newspeak, and the critical analysis of legal language as a technical apparatus of exclusion and domination. In order to do so, the analyzes of authors such as Luis Alberto Warat and Michel Foucault were used as a critical basis for the use of technicalities and arbitrary interpretations by the judiciary and state bureaucracy. In this way, the work tries to deconstruct the philosophical-technical argument of the language model addressed, questioning its semantic and pragmatic function in a world where educational abysses are commonly present in social relations.
