A judicialização da política, no Brasil, é um fenômeno inexorável e contingencial. Trata-se, pois, de um fato decorrente do modelo compromissório, dirigente e analítico que a Carta de Outubro adotou. A dimensão desse fenômeno, portanto, não pode depender da vontade solipsita do órgão judicante. Pelo contrário. O Poder Judiciário, neste caso – quando provocado – decide porque a Constituição obrigou-o a decidir. Desse modo, em um país de modernidade tardia, como é o caso do Brasil – onde as promessas da modernidade foram (in)cumpridas – é indene de dúvidas que o Judiciário passa a assumir um papel destaque no cenário brasileiro. Dito de outro modo: a desobediência dos demais poderes para com os objetivos que lhe foram impostos pela CRFB, implica que o Judiciário, como guardião da Constituição, cumpra àquilo que era, em tese, da competência dos outros poderes. Nesse quadro caó(s)tico, ganha sobremodo importância a – distinção – entrsubstancialismo(s) e ativismo judicial, porque – pretexto de cumprir uma política pública, sob o manto do substancialismo – , os juízes de terra e brasilisnão raro têm sido ativistas. Numa palavra: é pela falta de um controle hermenêutico e, por conseguinte, de uma teoria da decisão que a judicialização da política tem sido transformada na vulgata do ativismo.

The political judicialization, in Brazil, is an inaccurate and inoxerable phenomenon. It is about, then, a fact resulting from the engaged, leading and analytical model that the Letter of October has adopted. The dimmension of this phenomenom, therefore, can not depend on the solipsistic will of the judicial power. It is quite the opposite actually. The Judiciary, in this case – if instigated – decides why the Constitution imposed it to decide it. This way, in an untimely modernity country, like Brazil – where the promises of modernity have been (un)done – there are no doubts that the Judiciary has taken a highlighted role in the Brazilian scenery. In other words: the other powers’ desobedience concerning to the objectives which were imposed on them by the CRFB, implies that the Judiciary , as a guardian of the Constitution, carries out what was, in general, the competence of other powers. In this chaotic case, the distinction between substancialism and judicial activism has become important because – on the pretext to carry out a public politcs under the substancialism , judges from terrae brasilis -not rare-have been activists. In short: it is by the lack of a hermeneutical control and consequently, a lack of a theory of decision that the political judicialization has been changed in the vulgate of the activism.
