O presente trabalho tem por escopo promover uma análise do processo de criminalização do indivíduo, a partir da crônica Mineirinho de autoria de Clarice Lispector, cuja narrativa é conduzida em função da morte de um jovem socialmente rotulado como bandido, assassinado com treze tiros de metralhadora pela polícia carioca. Na obra se desenvolve uma densa análise, em nome da civilidade e do impacto em face da barbárie, acerca do poder de punir atribuído ao Estado, ainda se questiona o sentido e a real eficácia da Justiça e das formas de penalização legitimadas pelo Estado. Para isso, será realizada uma abordagem bibliográfica sobre a teoria do etiquetamento ou labelling approach, calcada no processo de estigmatização social do indivíduo, visto como uma reação social a conduta desviante e majoritariamente condenável.
The present work aims to promote an analysis of the process of criminalization from the individual, through the chronicle Mineirinho by Clarice Lispector, whose narrative is driven by the death of a young socially labeled as a bandit, murdered with thirteen machine gun shots by the police in Rio. In the work a dense analysis is developed, in the name of civility and the impact in the face of barbarism, on the power to punish attributed to the State, it is still questioned the sense and the real effectiveness of Justice and the forms of penalization legitimized by the State. For this, a bibliographical approach will be carried out on the theory of labeling approach, based on the process of social stigmatization of the individual, seen as a social reaction to deviant behavior and mostly reprehensible.
