O presente artigo analisa e descreve o Contrato de Rede de Empresas, contrato positivado pelo ordenamento jurídico italiano através do Decreto-Lei nº 5, de 10 de fevereiro de 2009, abordando os objetivos perseguidos pelo tipo contratual e seus elementos caracterizadores, bem como conjectura sobre as repercussões da adoção deste Contrato pelo ordenamento jurídico brasileiro. Para tanto, este artigo debruça-se sobre a base legal do Contrato de Rede de Empresas, investigando a origem do Decreto-Lei nº 5, de 10 de fevereiro de 2009 e a estrutura demandada por contratos dessa espécie.
The present work analyses and describes the Contract of Interfirm Network, established in Italian Law by the Decree-Law no. 5/2009 of February, considering its objectives and main features, as well as predict the impact of adoption of this Contract in brazilian legal system. To do so, this work scrutinizes the legal base of Contract of Interfirm Network, investigating the origin of Decree-Law no. 5/2009 of February and the structure claimed by this kind of contract.
