A constitucionalização dos sistemas internacionais de proteção aos direitos humanos proporciona a ampliação do bloco de constitucionalidade, exigindo, por conseguinte, que outros parâmetros objetivos sejam observados no controle de constitucionalidade lato sensu. Assim, a atividade judicativa internacional consolida-se como fonte autêntica de interpretação das disposições convencionais, a princípio, no exercício da jurisdição contenciosa. Porém, no sistema interamericano, analisa-se a própria juridicidade do resultado da interpretação convencional no exercício da função consultiva. Simultaneamente, o método indutivo, desenvolvido a partir da análise de casos, revela a preocupação da jurisprudência da Corte Interamericana em reforçar o dever de proteção dos Estados, por meio da atuação interna das autoridades que exercem funções soberanas.

The constitutionalization of international human rights protection systems provides the expansion of the constitutionality block, thus requiring that other objective parameters be observed in the lato sensu constitutionality control. Thus, the international judicative activity is consolidated as an authentic source of interpretation of the conventional provisions, in principle, in the exercise of the contentious jurisdiction. However, in the Inter-American system, it is analyzed the very juridicity of the result of conventional interpretation in the exercise of the consultative function. At the same time, the inductive method, developed from case analysis, reveals the concern of the jurisprudence of the Inter-American Court to reinforce the duty of protection of states, through the internal action of the authorities exercising sovereign functions.
