O presente trabalho visa a uma análise acerca da Constituição brasileira de 1988 e do elemento soberania em sua natureza integrante do Estado diante do plexo de vicissitudes do mundo moderno. Essa questão vem ganhando cada vez mais espaço no cenário mundial, pois com a globalização e as consequentes conexões que os Estados estão tendo de lidar com seus vizinhos nos seus mais diversos âmbitos sociais, dissonâncias são avistadas e causam temor nas relações internacionais. Com isso, o paradigma da soberania brasileira é posto em pauta na busca não de confirmá-lo perante suas características tradicionais, mas sim de enquadrá-lo no cenário atual para, com isso, corroborar sua força normativa e mostrar sua capacidade de se autoafirmar perante os demais Estados. Logo, o estudo do constitucionalismo torna-se essencial na busca por respostas sobre o verdadeiro significado de uma Constituição, tendo como foco principal a Constituição brasileira de 1988 e sua ideologia atual sob a ótica do intérprete hodierno.

The present work aims to a review of the 1988 Brazilian Constitution and the sovereighty as one natural part of the State on the vicissitudes of the modern world. This issue is gaining more space on the world stage, because with the globalization and the resulting connections that states are having to deal with its neighbors in its various social spheres, dissonances are sighted and cause fear in international relations. Thus, the paradigm of Brazilian sovereighty is put at hand in seeking not to confirm it before their traditional features, but to frame it in the current scene to thereby support their normative force and show their ability to assert themselves towards the other states. Therefore, the study of Constitucionalism becomes essential in the search for answers about the true meaning of a constitution, with the main focus in the Brazil’s Constitution of 1988 and its current ideology from the perspectives of today’s interpreter.
