Como o estereótipo criminal do traficante de drogas legitima a atuação estatal violenta?

O tráfico de drogas está entre uma das maiores causas de encarceramento no cenário nacional. A relevância do tipo na estrutura do sistema de repressão aos crimes mostra-se evidente diante do rigor punitivo e do cenário de violências que caracterizam a repressão ao delito. O presente artigo objetiva explicitar de que modo o estereótipo criminal do traficante de drogas, construído por meio do discurso da mídia e do Estado, legitima a atuação desproporcionalmente violenta contra tais indivíduos. Ademais, objetiva-se avaliar se há correspondência entre o referido estereótipo e os indivíduos que de fato são criminalizados pelo sistema punitivo. Para tanto, empregou-se como metodologia a revisão bibliográfica. Foram analisadas e revisitadas relevantes obras que discorrem sobre o tráfico de drogas no cenário nacional e sobre a questão do estereótipo criminal do traficante. A fim de conhecer quem são os indivíduos selecionados pela política criminal, foram também reunidas informações, dados estatísticos e estudos etnográficos os quais pudessem indicar o verdadeiro perfil do comerciante varejista de entorpecentes brasileiro. Ao final, constatou-se existir o emprego de desmedida violência aos indivíduos associados a este delito. Também se mostrou possível observar que os selecionados pelo sistema punitivo são, em sua maioria, indivíduos oriundos das camadas mais vulneráveis da população, atuando no comércio varejista de maneira independente, sem relação direta com episódios de violência ou envolvimento com organizações criminosas, em total discrepância à crença do imaginário popular de que tais pessoas sejam perigosas e violentas.

Drug trafficking is one of the biggest causes of incarceration on the national scene. The relevance of the subject in the structure of the punitive system is evident in the face of punitive rigor and the scenario of violence that characterize the repression of crime. This article aims to explain how the criminal stereotype of the drug dealer, constructed through the media and state’s discourses, legitimizes disproportionately violent actions against such individuals. Furthermore, the objective is to assess whether there is a correspondence between the aforementioned stereotype and the individuals who are actually criminalized by the punitive system. For that, the methodology used was the bibliographic review. Relevant works that discuss drug trafficking on the national scene and the issue of the criminal stereotype of the drug dealer were analyzed and revisited. In order to know who are the individuals selected by the criminal policy, information, statistical data and ethnographic studies were also gathered, which could indicate the true profile of the Brazilian drug dealer. In the end, it was found that excessive violence was used against individuals associated with this crime. It was also possible to observe that those selected by the punitive system are, for the most part, individuals from the most vulnerable sections of the population, acting independently in the retail trade, with no direct relationship with episodes of violence or involvement with criminal organizations, in total discrepancy with popular belief that such people are dangerous and violent.
