O presente trabalho, elaborado a partir do estudo de diversos doutrinadores, enfrenta a questão das cinco dimensões (ou gerações) de direitos fundamentais, abordando suas origens históricas e evolução no decorrer dos séculos. Sabe-se que a existência de cinco gerações de direitos fundamentais não é pacífica na doutrina, mas o direito à paz, considerado um direito novo e essencial, ocupa uma posição de destaque, sendo colocado por muitos como precursor da quinta geração dos direitos fundamentais e por outros como parte integrante de gerações anteriores. Por sua vez, a democracia participativa, pertencente à quarta geração de direitos fundamentais e elencada por Paulo Bonavides como melhor opção aos sistemas de governo existentes, encontra óbices práticos à sua efetivação, o que será visto no decorrer da pesquisa.
Resumo Inglês:
The present work, based on the study of several doctrinaires, addresses the question of the five dimensions (or generations) of fundamental rights, addressing their historical origins and evolution over the centuries. It is known that the existence of five generations of fundamental rights is not peaceful in doctrine, but the right to peace, considered a new and essential right, occupies a prominent position, being placed by many as the precursor of the fifth generation of fundamental rights and by others as an integral part of previous generations. On the other hand, participatory democracy, belonging to the fourth generation of fundamental rights and listed by Paulo Bonavides as the best option for the systems of government, finds practical obstacles to its implementation, which will be seen in the course of the research.
