Tendo em vista o reconhecimento da propriedade fiduciária e a sua vasta utilização com
respaldo na legislação vigente, verifica-se algumas discussões sobre a matéria principalmente após o
advento da Lei 11.101/2005, em substituição ao Decreto-Lei 7.661/1945, que não submeteu aos efeitos da
recuperação judicial os créditos decorrentes da propriedade fiduciária de credor. Assim, busca o trabalho
trazer alguns conceitos necessários ao debate sobre a matéria, traçar o significado de cada um dos
conceitos elementares, bem como opinar e trazer algum entendimento jurisprudencial sobre a matéria,
principalmente no que versa sobre a possibilidade de submeter aos efeitos da recuperação judicial os
créditos cedidos fiduciariamente.

Given the recognition of fiduciary property and the widespread use backed on existing
legislation there is some discussion on this subject especially after the advent of Law 11.101/2005, in
replacement of Decree-Law 7.661/1945, not subjected to the effects of judicial recovery claims arising
from fiduciary property creditor. Thus, the work seeks to bring some concepts necessary for the debate on
the matter, delineate the significance of each of the elementary concepts, and opinions and bring some
understanding jurisprudence on the matter, mainly in what concerns the possibility of referring to the
effects of judicial recovery the credits assigned trustee.
