O presente ensaio analisa a Emenda Constitucional 88, de 07.05.2015, e os seus possíveis impactos na jurisdição constitucional brasileira. Pretendeu-se demonstrar que a PEC da Bengala antes constitui uma manobra política do Legislativo, em uma interação hostil entre os poderes públicos, que uma tentativa de zelar pela neutralidade ideológica dos magistrados. À luz de outros exemplos de diálogos constitucionais e do modelo institucional de comportamento judicial, verifica-se que o Judiciário não costuma ser indiferente a constrições desse tipo.
Resumo Inglês:
This essay analyzes the Constitutional Amendment 88, of 05.07.2015, populary called Sticks Bill, and its possible impacts on the Brazilian constitutional jurisdiction. It intended to demonstrate that this political maneuver before the legislatureis is an hostile interaction between government, more than an attempt to ensure the ideological neutrality of judges. In light of other examples of constitutional dialogue and institutional model of judicial behavior, it turns out that the judiciary is not usually indifferent to such constraints.
