O presente artigo pretende analisar a relação de trabalho dos motoristas na empresa Uber a partir de direitos trabalhistas constitucionalmente consagrados, focando especialmente na garantia do salário mínimo e da jornada de trabalho. Nessa esteira, entende-se que para a consolidação de um patamar civilizatóriomínimo de direitos humanos, a Constituição estabeleceu a proteção do trabalho digno por meio de institutos que contrapõem a crescente precarização do trabalho. Assim, explora-se o contexto de informatização dos ofícios e avanço da economia do compartilhamento.
The present article analyses the working relationship of the drivers on the company Uber based on constitutionally consolidated labor rights, focusing especially on the guarantee of the minimum wage and the working day. This way, it is understood that for the consolidation of a minimum level of human civilization, the Constitution established the protection of decent work through institutes that counteract the growing prevaricationof work. Nevertheless, the context of computerization of works and the advancement of the sharing economy are explored.
