Em nome do dito desenvolvimento nacional, mais uma Usina Hidrelétrica está em processo de construção, trata-se da chamada Usina Hidrelétrica de Tabajara, localizada no município de Machadinho D’Oeste, em Rondônia. O presente artigo objetiva estabelecer um raciocínio teórico sobre como estão os processos de estudo e de constrição do referido empreendimento, bem como compreender a forma como o Ministério Público Federal está atuando na fiscalização dos direitos das populações indígenas residentes nas proximidades da região na qual será construída a referida Usina Hidrelétrica (UHE), direitos estes assegurados tanto constitucionalmente quanto em legislação infraconstitucional. Sabe-se que não houve atenção quanto ao atendimento das necessidades dessas populações durante a construção de outras usinas no estado de Rondônia. Justamente por isso é que, por meio deste artigo, busca-se avaliar os procedimentos que estão sendo adotados pelas autoridades competentes, de modo a, de fato, considerar os prejuízos causados às populações tradicionais decorrentes deste tipo de empreendimento, os quais, supostamente, são entendidos como sustentáveis, quando, na verdade, dilaceram o modo de vida e, com frequência, a identidade cultural desta população, sendo compreendida como o refugo social no contexto da construção de Usinas Hidrelétricas no estado de Rondônia. Compreende-se que o MPF está tendo uma atuação fundamental na busca pela garantia dos Direitos Fundamentais das populações indígenas, mesmo que pressionado por outros poderes do Estado e do capital privado nacional e internacional que, por sua vez, tem tido maior êxito na garantia de seus interesses.

In the name of said national development, another Hydroelectric Plant is in the construction process, the so-called Tabajara Hydroelectric Plant, located in the municipality of Machadinho D’Oeste, in Rondônia. This research report aims to establish a theoretical reasoning about how the study and constriction processes of the aforementioned enterprise are going, as well as understanding the way in which the Federal Public Ministry is acting in monitoring the rights of indigenous populations residing in the vicinity of the region in which the aforementioned Hydroelectric Power Plant (UHE) will be built, rights guaranteed both constitutionally and in infra-constitutional legislation. It is known that there was no attention paid to meeting the needs of these populations during the construction of other plants in the state of Rondônia. Precisely for this reason, through this article, we seek to evaluate the procedures that are being adopted by the competent authorities, in order to, in fact, consider the damage caused to traditional populations resulting from this type of enterprise, which, supposedly, they are understood as sustainable, when, in fact, they tear apart the way of life and, often, the cultural identity of this population, being understood as social waste in the context of the construction of Hydroelectric Power Plants in the state of Rondônia. It is understood that the MPF is playing a fundamental role in the search for guaranteeing the Fundamental Rights of indigenous populations, even if pressured by other powers of the State and national and international private capital which, in turn, has had greater success in guaranteeing your interests.
