Resumo Português:

Toda a situação jurídica assenta sobre uma realidade histórica, que dela passa a ser constituinte. Assim
acontece também com os negócios que se celebram: estão historicamente situados. Por isso, a alteração
das situações fácticas que são o pressuposto deles não pode deixar de os atingir. Servir a justiça consiste
assim em preservar a manifestação concreta de autonomia que foi substancialmente consentida, e não em
impor uma cega subordinação aos preceitos que a exprimiram em circunstâncias históricas diferentes. A
revisão a que se procede no âmbito da alteração das circunstâncias não é inimiga da autonomia privada e
do poder auto-vinculativo da vontade.

Resumo Inglês:

All the legal situation seats on a historical reality, that becomes its constituent. Thus it happens also with
the businesses: they are historically situated. Therefore the alteration of the factual situations affects the
foundations of the contracts. To serve justice consists thus on preserving the concrete manifestation of
autonomy that substantially was assented, and not in imposing a blind subordination to the rules that had
been stated in different historical circumstances. The revision of the contracts because of the alteration of the
circumstances is not an enemy of the private autonomy and the vinculum created by the will.
