Neste artigo faremos uma análise do papel dos Poderes Legislativo e Judiciário a partir da decisão liminar proferida pelo Ministro Luiz Fux no Mandado de Segurança 34.530, na qual determinou o reinício do trâmite do projeto de iniciativa popular 4.850/2016, com medidas de combate à corrupção na Câmara dos Deputados, em razão de alterações propostas e aprovadas naquela Casa legislativa que desvirtuavam a natureza do instituto da iniciativa popular para deflagrar um projeto de lei.

In this article, we will analyze the role of the Legislative and Judicial branches from the preliminary decision handed down by Minister Luiz Fux in writ of mandamus No. 34,530, in which ordered the resumption of the process of the popular initiative project No. 4,850 / 2016 with measures to combat corruption to the Chamber of Deputies due to changes proposed and approved in that House that detracted from the nature of the institute of popular initiative to set off a bill.
