Este artigo analisa a possível responsabilização civil do Estado por intoxicações ocupacionais de trabalhadores rurais autônomos expostos a agrotóxicos. Diante do uso intensivo dessas substâncias no Brasil e da ausência de proteção institucional adequada, destaca-se a omissão estatal em suas funções constitucionais de fiscalização e proteção à saúde e ao meio ambiente. Com abordagem qualitativa e in-terdisciplinar, fundamentada em revisão bibliográfica e análise normativa, defende-se que a inércia estatal, quando existente nexo causal com o dano, configura responsabilidade objetiva por omissão específica. O estudo aponta a necessidade de reorientar políticas públicas, reconhecer direitos fundamentais desses trabalhadores e garantir mecanismos eficazes de reparação jurídica.
This article analyzes the potential civil liability of the State for occupational pesticide poi-soning affecting self-.employed rural workers. In light of the intensive use of such substances in Brazil and the lack of adequate institutional protection, the study highlights the State’s omission in fulfilling its constitutional duties of oversight and protection of public health and the environment. Based on a qual-itative and interdisciplinary approach, grounded in bibliographic review and normative analysis, it argues that when there is a causal link between State inaction and the harm caused, strict liability for specific omission applies.
