O presente artigo visa descobrir a atual interpretação atribuída ao direito à vida bem como rastrear a sua história de proteção partindo-se das origens ocidental e oriental. Buscou-se compreender a forma como se consolidou e conhecer os fundamentos históricos, filosóficos, éticos, sociais e jurídicos que embasaram à sua escolha ao longo da evolução humana. Para tanto, analisaram-se o direito à vida como direito humano, a evolução histórica de sua proteção, a tutela nacional e internacional e os entendimentos jurisprudenciais da Corte Internacional de Justiça, da Corte Interamericana de Direitos Humanos e do Supremo Tribunal Federal. A pesquisa foi realizada por meio do método dedutivo de abordagem, com técnica de pesquisa bibliográfica em referências nacionais e estrangeiras. Concluiu-se que o direito à vida é manifestamente histórico, universal, fundamental e relativo.



Resumo Inglês:

This article aims to discover the present interpretation attributed to the right to life as well as to track down its history of protection starting from the eastern and the western origins. The objective was to understand the way how this right was consolidated and know the historical, philosophical, ethical, social and legal elements that based its selection along the human evolution. For this purpose, the right to life as a human right, the historical evolution of its protection, the national and international protectorship and the International Court of Justice, the Inter-American Court of Human Rights and the Federal Supreme Court understandings were analysed. The survey was conducted according to the deductive method of approach with bibliographic and documental research technique from national and international references. It was concluded that the right to life is clearly historical, universal, fundamental and relative.
