Este estudo objetiva apresentar o acesso à justiça e a assistência jurídica gratuita, corolário do primeiro, como elementos integrantes da composição dos Estados modernos. Realizando-se a análise de textos clássicos ligados à filosofia (ou teoria) do Estado, verificou-se como as necessidades humanas se relacionam com a concepção clássica da formação das sociedades organizadas, ideia que, de alguma forma, encontra-se presente, séculos depois, na teoria do Estado de Direito, especialmente no que concerne ao reconhecimento de direitos fundamentais a todos os indivíduos. O amplo reconhecimento de direitos operado pela atividade legislativa, todavia, não foi capaz de evitar eventos de opressão e abusos de poder. Essas situações colocaram em xeque as aspirações de igualdade e a capacidade do poder público como seu garante, o que deslocou o papel do sistema de justiça para uma posição de protagonismo e seu próprio reconhecimento como direito humano. A necessidade de se garantir acesso à justiça, todavia, não se perfaz sem que se garanta assistência jurídica. O direito a ter direitos, portanto, opera como elemento chave da formação do Estado de Direito. A pesquisa foi realizada através de revisão bibliográfica.

This study aims to present access to justice and free legal aid as composing elements of modern states. By analyzing classic texts related to the philosophy (or theory) of the State collected by a bibliographic review, we verified an association between human needs and the traditional conception of the formation of organized societies – an idea somehow present in the theory of the Rule of Law, centuries later, especially regarding the recognition of the universality of fundamental rights. However, the broad recognition of rights operated by legislative activity has not been able to prevent oppression and power abuse. These situations outline the aspirations for equality and the public power resolution in assuring it, indicating the key role of the system justice and its recognition as a human right. Considering that the need for guaranteeing access to justice is not fulfilled without guaranteeing legal aid, the right to have rights is crucial for the formation of the Rule of Law.
