RESUMO Os Direitos Humanos são conquistas e frutos advindos de acontecimentos históricos europeus, sendo a sua internacionalização demarcada pelo período pós-guerra, com a criação da Organização das Nações Unidas. Com a internacionalização e a positivação desses direitos, a universalidade se tornou uma das principais características dos Direitos Humanos, que rege todo o sistema de proteção internacional global. O universalismo busca garantir que todas as pessoas, independentemente de qualquer condição, possuam direitos humanos. Contudo, a característica universalista dos direitos humanos sofre severas críticas por ser alegado que se trata de uma tentativa de homogeneizar as culturas, que não respeita a diversidade e peculiaridade de cada povo. Em contraponto, temos a teoria relativista, que consiste em uma proposta teórica que possui a finalidade de proteger a singularidade de cada cultura, repulsando a ideia de moral una.

ABSTRACT The Human Rights are achievements from historical European events, being demarcated by the internationalization by the post-war period, with the creation of United Nations. With the internationalization and the recognition of these rights, universality has become one of the main features of human rights, which rules all international global protection system. Universalism search to ensure that all people, regardless of any condition, have human rights. However, the universal feature of human rights suffers harsh criticism for being alleged that this is an attempt to homogenize cultures which doesn’t respect the diversity and the uniqueness of each people. In the other way, there’s the relativistic theory, which is theory proposal that has the purpose to protect the uniqueness of each culture, rejecting the idea of a single moral.
