RESUMO Este artigo propõe demonstrar a plausibilidade da intervenção judicial do MPT, direcionada para tutelar o direito social do trabalho, em busca de maior efetividade no resultado das políticas públicas de incentivos fiscais. A discussão partirá da análise de bases jurisprudenciais, teóricas e normativas que indicam ou não a possibilidade de controle dessa natureza. Amparado nos alicerces da Análise Comportamental do Direito, examinará os comportamentos de agentes políticos e econômicos no desenvolvimento dessas políticas, para, ao final, demonstrar que o controle judiciário das contrapartidas das políticas de extrafiscalidade não é só legal como também é absolutamente necessário.

ABSTRACT This article proposes to demonstrate the plausibility of the judicial intervention of the MPT, aimed at protecting the social labor law, in search of greater effectiveness in the results of the public policies of fiscal incentives. The discussion will start from the analysis of jurisprudential, theoretical and normative bases that indicate or not the possibility of control of this nature. Based on the foundations of the Behavioral Analysis of Law, it will examine the behavior of political and economic agents in the development of these policies, in order to demonstrate that judicial control of the counterparts of extrafiscal policies is not only legal but absolutely necessary.
