RESUMO O presente artigo busca analisar o impacto das alterações promovidas pelo CPC/2015 à Súmula 381/STJ, que proíbe que o juiz conheça de ofício a abusividade de cláusulas dos contratos bancários. O objetivo central será a demonstração de que o fortalecimento do princípio do contraditório com a previsão expressa, na legislação infraconstitucional, da vedação à prolação de decisão surpresa, impondo-sea prévia consulta às partes, ainda que de matéria de ordem pública se trate, não compele a modificação do entendimento sumulado

ABSTRACT This article analyzes the impact of the changes promoted by the CPC/2015 to the 381/STJ Summary Statement, which prohibits the courts from making order of its own initiative on cases related to the abusiveness of clauses in bank contracts. The main objective shall be to demonstrate that the strengthening of the adversarial principle under the provision, in infra-constitutional legislation, from the prohibition summary judgement, imposing prior hearing with the parties, even if it is a matter of publicorder, it does not result on the alteration of the summary statement.
