As discussões de cunho filosófico aproximam mais o julgador do fato e da necessidade do
jurisdicionado, do seu próximo, do seu igual. As partes não pretendem apenas aguardar uma decisão eminentemente técnica. Assim, acompanhando, na íntegra, o pensamento do Desembargador Renato Nalini2, acredito e ratifico que a sociedade ainda tem no Judiciário uma esperança duradoura, não eterna, por saber que o Estado-Juiz tem o dever de tutelar os conflitos sociais mantendo a coexistência e paz sociais. Isto mesmo! Se o juiz é um do povo, veio do povo e estudou os conflitos do povo, para resolvê-los, por qual motivo não falar a linguagem do povo? Este povo que é o patrão de todos nós! Assim, é certo que grande parte da nossa formação cultural é extraída do nosso convívio familiar, das nossas origens e dos nossos relacionamentos primeiros. E por isto, resta fácil a compreensão de que a influência do comportamento humano deve ser regrada. E a Filosofia associada aos princípios funciona como norte e balizador aos julgadores quando da manifestação judicial.
