Este artigo tem o intuito de abordar a problemática que envolve a identidade do nascituro, encontrando respostas na doutrina sobre qual é o status do nascituro atualmente no direito brasileiro, compreendendo, por sua vez, se o concepto é ou não considerado pessoa e quando se dá o início de sua personalidade jurídica. A partir dessa premissa, será analisada, também, a proteção constitucional assegurada ao nascituro por meio dos direitos fundamentais.

This article aims to address the issues surrounding the identity of the unborn, finding answers in the doctrine about the status of the unborn currently in Brazilian law, comprising, in turn, if or not the unborn is considered a person and when its legal personality starts. From this premise, will also be analyzed the constitutional protection assured to the unborn through fundamental rights.
