O silenciamento da liberdade de expressão na sociedade digital da desinformação

Este ensaio almeja trazer uma reflexão científica de que maneira a lógica algorítmica intrínseca das plataformas digitais tem provocado o silenciamento e o consequente amesquinhamento da liberdade de expressão dos indivíduos que integram a sociedade digital, mediante a criação de bolhas digitais que se encontram predispostas a disseminar desinformação e fake news. A presente investigação percorre, inicialmente, a trilha conceitual do que se deve entender por fake news à luz da verdade e da falsidade e em que medida os seus contornos desfrutam de relevância para o direito. Em seguida, mergulha nas dificuldades que o direito enfrenta quando tenta proteger a liberdade de expressão contra a lógica algorítmica das redes sociais digitais. E, por fim, aborda a problemática das bolhas digitais, que alimentam a polarização e a desinformação da sociedade digital.

This essay aims to bring a scientific reflection on how the intrinsic algorithmic logic of digital platforms has caused the silencing and the consequent diminishment of the freedom of expression of individuals who make up the digital society, through the creation of digital bubbles that are predisposed to disseminate misinformationand fake news.The present investigation initially covers the conceptual path of what is meant by fake news in the light of truth and falsehood and to what extent its contours enjoy relevance for the law.Then, it dives into the difficulties that the law faces when trying to protect freedom of expression against the algorithmic logic of digital social networks.And, finally, it addresses the issue of digital bubbles, which fuel the polarization and misinformation of the digital society.
