RESUMO Esse artigo visa estudar os efeitos do manejo da Ação Popular, principalmente, pesquisar os direitos difusos e coletivos como forma de garantia de acesso à justiça e a proteção aos direitos da personalidade, como finalidade o princípio da dignidade da pessoa humana. Objetivo deste artigo é demonstrar que a Constituição Federal de 1988 garante o livre acesso ao poder judiciário a todas as pessoas que forem lesionadas ou terem algum direito violado requerendo a devida reparação, e, em especial aos cidadãos como legitimados ativos de ingressar com demanda visando à proteção do patrimônio público, da moralidade administrativa e do meio ambiente. A garantia efetiva da Ação Popular se baseia em que todos os cidadãos possam ser informados dos direitos que possuem, como a oportunidade de acesso ao judiciário para reclamá-los. A metodologia adotada na pesquisa foi à revisão bibliográfica, e foi desenvolvida baseada em materiais publicados em livros e artigos, pesquisados fisicamente ou pela internet.

ABSTRACT This article aims to study the effects of the management of Popular Action, mainly to investigate diffuse and collective rights as a way of guaranteeing access to justice and protection of the rights of the personality, as a purpose the principle of the dignity of the human person. The purpose of this article is to demonstrate that the Federal Constitution of 1988 guarantees free access to the judiciary to all persons who are injured or have some violated rights requiring proper redress, and especially to citizens as legitimized assets of joining with demand aiming at the protection of the public patrimony, administrative morality and the environment. The effective guarantee of the Popular Action is based on that all citizens can be informed of the rights they have, such as the opportunity to access the judiciary to claim them. The methodology adopted in the research was the bibliographic review, and was developed based on materials published in books and articles, searched physically or by the internet.
