O presente artigo tem como objetivo traçar a atuação das principais organizações criminosas brasileiras e analisar em que medida as políticas de descriminalização das drogas implementadas por Portugal e Uruguai poderiam ser aplicadas no Brasil. Para isso, o primeiro capítulo define a estrutura, o funcionamento e o papel das drogas nas principais organizações criminosas do Brasil e apresenta o funcionamento do crime organizado em Portugal e no Uruguai; o segundo capítulo aborda a legislação das drogas vigente no Brasil e as consequências espelhadas no colapso do sistema prisional; o terceiro tópico, por sua vez, investiga as políticas públicas de descriminalização das drogas em Portugal e no Uruguai e os resultados obtidos; e por fim, verifica-se a possibilidade de implementação de tais políticas no Brasil, questionando o impacto que teria em relação à estrutura e funcionamento do crime organizado. Fica demonstrado que as políticas apresentadas só seriam eficazes se atreladas à ações do Estado que efetivamente garantam os direitos sociais e que, ainda assim, esta não seria a solução para o fim das organizações criminosas, que hoje atuam também em diversas outras atividades ilícitas.

This article aims to outline the performance of the main Brazilian criminal organizations and analyze to what extent the drug decriminalization policies implemented by Portugal and Uruguay could be applied in Brazil. For this, the first chapter defines the structure, functioning and role of drugs in the main criminal organizations in Brazil and presents the functioning of organized crime in Portugal and Uruguay; the second chapter addresses the current drug legislation in Brazil and the consequences mirrored in the collapse of the prison system; the third topic, in turn, investigates public policies for the decriminalization of drugs in Portugal and Uruguay and the results obtained; and finally, the possibility of implementing such policies in Brazil is verified, questioning the impact it would have on the structure and functioning of organized crime. It is demonstrated that the policies presented would only be effective if linked to State actions that effectively guarantee social rights and that, even so, this would not be the solution to the end of criminal organizations, which today also operate in several other illicit activities.
