Através da busca amparada nos pressupostos do constitucionalismo, pode-se alcançar novas faces para a compreensão e o enfrentamento do ativismo judicial. Esta questão é alvo de um debate atual tanto na doutrina nacional como na estrangeira. Perpassando pelos poderes excessivos exercidos pelos juízes ou pela exorbitância de atuação em sua esfera de poder, desaguando no protagonismo do Poder Judiciário no trato de questões sociais, enfrentando a judicialização da política, bem como embates constitucionais, e os seus reflexos na teoria da separação dos poderes. As decisões judiciais oriundas do ativismo judicial podem ser analisadas pela ótica positiva ou negativa quanto ao enfrentamento das demandas jurisdicionais.

This question is the subject of an ongoing debate both in domestic and foreign doctrine. Running along the excessive powers exercised by judges or by exorbitant acting within its sphere of power flowing into the role of the judiciary in dealing with social issues facing the legalization of politics and constitutional struggles, and their reflections in the theory of separation of powers. The coming judgments of judicial activism can be analyzed by positive or negative perspective in addressing the jurisdictional demands.
