O presente artigo tem por objetivo realizar um paralelo entre Brasil e Filipinas com o intuito de compreender como aspectos culturais e históricos são fatores determinantes para a produção de emendas constitucionais, produzindo resultados distintos, apesar da adoção de uma estrutura constitucional semelhante. Da mesma forma, pretende-se investigar como as funções interpretativas das Supremas Cortes substituem as mudanças formais por métodos mais rápidos e menos conflituosos.
The purpose of this article is to draw a parallel between Brazil and the Philippines in order to understand how cultural and historical aspects are determining factors for the production of constitutional amendments, producing distinct results, despite the adoption of a similar constitutional structure. Likewise, it is intended to investigate how the interpretive functions of the Supreme Courts replace formal changes with faster and less conflicting methods.
