IMPACTOS DA LEI GERAL DAS MICRO E PEQUENAS EMPRESAS NO DESENVOLVIMENTO DAS COMPRAS PÚBLICAS DO CEARÁ

A elaboração da Lei Geral das Micro e Pequenas Empresas surge com a reforma tributária, em 19/12/2003. Em 14/12/2006 é criada a Lei Complementar 123/06 (Lei Geral das Micro e Pequenas Empresas – Simples Nacional), novo estatuto nacional das microempresas e empresas de pequeno porte. O trabalho identifica os ajustes que as micro e pequenas empresas tiveram que implementar para expandir suas vendas aos órgãos públicos, a partir do surgimento e implantação da Lei Complementar 123/06. A metodologia deste estudo consiste na abordagem ao problema e a natureza que é quanti-qualitativa; em relação aos fins, é exploratória e descritiva; quanto aos meios é bibliográfica, documental, de campo e ex post facto; e efetuou-se um levantamento com cento e catorze micro e pequenas empresas fornecedoras do Estado do Ceará, dos certames eletrônicos de 2008 da BNB, TRE-CE e UFC. Os resultados demonstram a evolução da participação das micro e pequenas empresas em 294% (duzentos e noventa e quatro por cento), como fornecedoras de órgãos públicos, e mostram que não houve dificuldades encontradas pelas micro e pequenas empresas do Estado do Ceará em atender aos requisitos da Lei Complementar 123/06. Como possíveis dificuldades em seu desenvolvimento, identificaram-se a contratação de pessoal especializado em vendas ao governo, aquisição de softwares e sistemas operacionais. Ainda, como resultados, identificam-se as tecnologias adquiridas como compra de equipamento de informática, contratação de banda larga e inovações de processo que foram implementadas, em decorrência dos aumentos nas vendas e capacitação de fornecimento com acesso a outros mercados pelas micro e pequenas empresas do Estado do Ceará

The elaboration of the General Law of the Micro and Small Companies appears with the
reform tax, in 19/12/2003. In 14/12/2006 Complementary Law 123/06 is created (General
Law of the Micro and Small Companies - Simple National), new national statute of the microcompanies
and small business companies. The work identifies the adjustments that the micro
and small companies had that to implement to expand its sales to the public agencies, from
the sprouting and implantation of Complementary Law 123/06. The methodology of this
study consists of the boarding to the problem and the nature that is quanti-qualitative; in
relation to the ends, it is exploratory and descriptive; how much to the ways he is
bibliographical, documentary, of field and former post fact; one effected a survey with 114 micro and small supplying companies of the State of the Ceará, the Electronic Convention of
2008 of the BNB, TRE-CE and UFC. The results demonstrate to the evolution of the
participation of the SME‟s (small and medium enterprises) in 294% (two hundred and ninety
four percent), as supplying of public agencies, and show that it did not have difficulties found
for the micron and small companies of the State of the Ceará in taking care of to the
requirements of Complementary Law 123/06. As possible difficulties in its development act
of contract of staff specialized in sales to the government was identified to it, acquisition of
software and operational systems. Still, as resulted, the acquired technologies are identified as
computer science equipment purchase, act of contract of broad band and innovations of
process that had been implemented, in result of the increases in the sales and qualification of
supply with access to other markets for the micro and small companies of the State of the
Ceará.
