O presente artigo busca tecer algumas considerações sobre a atual conjuntura do Brasil e a influência do direito constitucional de acesso à saúde em tempos de calamidade pública. Para tanto, procurou-se tratar, de forma sintética, a respeito do conceito abstrato do direito ao acesso à saúde como corolário dos direitos humanos encartados em nossa Constituição Federal, para só depois adentrar na definição dos reflexos na vida da sociedade. O presente ensaio se propõe a responder o questionamento acerca da influência política e da falta de isonomia no acesso ao sistema de saúde brasileiro e como essa disparidade fora agravada em momentos de crise sanitária. O tema proposto ganha relevância no atual cenário pandêmico que o mundo todo perpassa ante a propagação nunca antes vista na história da sociedade moderna e como o Brasil poderá preparar-se para eventuais situações vindouras partindo do prisma político jurídico pátrio.

This article seeks to make some considerations about the current conjecture of Brazil and the influence of the constitutional right of access to health in times of public calamity. To this end, we attempted to deal, in a synthetic way, with respect to the abstract concept of the right to access to health as a corollary of the human rights included in our Federal Constitution, only then to enter into the definition of the reflexes in the life of society. This essay aims to answer the question about the political influence and the lack of equality in access to the Brazilian health system and how this disparity had been aggravated in times of health crisis. Theproposed theme gains relevance in the current pandemic scenario that the whole world is going through before the spread never before seen in the history of modern society and how Brazil can prepare itself for possible future situations starting from the national legal political prism.
