O presente artigo traça uma análise da utilização, pelo juiz, do depoimento prestado pela testemunha na fase investigativa, buscando situá-la em algum ponto do filete de intensidades que conectam operadores autoritários e democráticos em determinado modelo processual penal, nomeadamente o brasileiro. Busca-se, com isso, decalcar os contornos do autoritarismo que orbitam sobre tal ato e apresentar o contraditório dinâmico e uma devida implementação de regras de inutilização como a forma mais eficaz de obstruí-lo. Para isso, nos valemos principalmente dos estudos acerca do autoritarismo de Fragoso e, especificamente no processo penal, de Gloeckner e dos italianos Fazzalari e Ferrua, respectivamente para revisitarmos o contraditório e as regras de inutilização. Por fim, demonstramos a necessidade de defenestrar todos os constritores epistêmicos que permitem a direta ou indiretamente o depoimento da testemunha em fase preliminar, o que perpassa necessariamente pela revitalização do contraditório e de regras que refreiem eventuais pulsões autoritárias que encontram no livre convencimento motivado, terreno fértil para se manifestar.
This article presents an analysis of the judge’s use of the testimony given by the witness in the investigative stage, seeking to place it at some point in the chain of intensities that connect authoritarian and democratic operators in a particular criminal procedural model, specifically the Brazilian. It seeks to reduce the contours of authoritarianism that orbit this act and to present the dynamic contradictory and a proper implementation of rules of disuse as the most effective way to obstruct it. In order to do this, we mainly rely on the studies of Fragoso’s authoritarianism and, specifically in criminal procedure, on Gloeckner’s and on the Italians Fazzalari and Ferrua, respectively, to revisit the contradictory and ruin rules. Finally, we demonstrate the need to eliminate all the epistemic constraints that directly or indirectly allow witness testimony in the preliminary phase, which necessarily goes through the revitalization of the contradictory and rules that restrain any authoritarian drives that find in the free convincing motivated fertile ground to manifest.
