Através dos métodos lógico, dedutivo e comparativo, o presente trabalho tenciona realizar análise do instituto do Estado de Coisas Inconstitucional, há algum tempo trabalhado pela Corte Constitucional Colombiana, e mais recentemente introduzido nas discussões pátrias. Dentre os vários enfoques possíveis, a atuação do Poder Judiciário na aplicação do instituto e os necessários controles a serem desempenhados pela função judicante como medida necessária à harmonia da repartição constitucional de funções.
Resumo Inglês:
Through logical, deductive and comparative methods, this text intends the analysis of the Unconstitutional State of Things, worked by the Colombian Constitutional Court, and more recently introduced into the homelands discussions. Among the many possible approaches, the role of the Judiciary in the institute's application and the necessary controls by the adjudicative function as a necessary question for the harmony of the constitutional division of functions.
